Terms

These are the terms of sale. They are written to be read, and where a term is unusual the reason for it is given rather than left to be guessed at.

Who you are dealing with

Peaberry is a trading name of Antipode Technologies Inc., a company incorporated in Ontario, Canada. Contracts of sale are with that company. These terms are governed by the law of Ontario.

Prices and tax

Every price on the site is in Canadian dollars. Sales tax is added at your province's rate and shown before the card is charged. Import duty is not added at any point, because it was already paid on the bulk shipment before the item was listed.

Prices change. The price that applies is the one displayed when your order is accepted. If an item is listed at an obviously wrong price, we may decline the order and refund you rather than fulfil it, and we will say so rather than let it sit.

Orders

Placing an order is an offer to buy. The contract forms when we send the confirmation. We can decline an order, and the reasons that actually happen are that stock has run out, the price was wrong, or the delivery address is one we cannot serve.

Delivery

Delivery estimates are estimates. Risk passes to you on delivery, not on dispatch, so a parcel lost or damaged in transit is our problem to solve, not yours to argue with a courier about.

Returns and cancellation

Unopened equipment may be returned within thirty days of delivery for a full refund, with return shipping at our cost. Opened equipment may be returned within the same period if it is complete and undamaged.

Coffee is a perishable food and cannot be resold once it has left our control, so it is not returnable. That is not a way of avoiding responsibility for it: a bag that is stale, faulty or not what its label says will be replaced or refunded, and we will not ask for it back.

Refunds go to the original payment method within ten business days of the return arriving, or of us agreeing to it in the case of coffee.

Warranty

Equipment carries the manufacturer's warranty, and its term is stated on the product page. We administer claims on your behalf. Nothing in these terms removes the statutory conditions and warranties that provincial consumer protection law implies into a sale, and where a term here conflicts with that law, the law wins.

What we do not promise

We sell equipment and coffee. We do not promise that a given grinder will suit your taste, that a brewer will produce a particular result, or that any product is fit for a commercial or high-volume setting unless the page says so. Advice on the site and in the guides is given in good faith and is not a warranty.

Our liability for any order is limited to the amount you paid for it, except where the law does not permit that limit, which includes death, personal injury and anything caused by our own negligence or bad faith.

The guides

Pages published under this site are written to be accurate and are reviewed with a date on them. They are general information about brewing coffee and about buying it in Canada. Where they describe customs, tax or consumer law, they describe it as we understand it on the review date, and they are not legal advice.

Changes

These terms change from time to time. The version that applies to an order is the version published when the order was accepted. The review date at the top of this page says when it last moved.
